To request a current copy of any governing document (Declaration, By-Laws, etc), you must enter a Request for Records through the Condominium Authority of Ontario (CAO).
By-Law #7 proposes to repeal Article XIII and Schedule A of By-Law #1
What repealing Article XIII means: Currently, unit owners are able to request a meeting to consider any new rules put in place by the Condo Board. The rules only go into effect if quorum is reached at such meeting and a majority vote in favour (“Affirmative Approval”). Upon the repeal of Article XIII, owners would now be required to form a quorum (44 unit owners) at a requisitioned meeting to consider new rules. If a quorum isn’t reached at the first meeting, the new rules immediately go into effect. If a quorum is reached, the majority vote would determine if the rules go into effect.
What repealing Schedule A means: All 25+ rules listed in Schedule A would be removed. Only rules that are also explicitly listed in the Declaration or the Ontario Condominium Act would remain in place. For example, since limits on pet size and quantity, as well as a requirement to get Condo Board approval before making installations on common elements (ie: backyard), are also listed in the Declaration, they are unable to be changed by newly proposed By-Law #7.
